Referral to the police - 5 December 2016
On 5 December 2016, the Electoral Commission referred an incident to Police in response to a complaint about a demonstration in the electorate on the day of the Mt Roskill By-election.
It is an offence under section 197 of the Electoral Act 1993 to, on election day, hold or take part in a demonstration or procession or to make statements using a loudhailer having direct or indirect reference to the poll, or to exhibit a statement likely to influence any elector as to how they should vote.
As this matter is now with the Police, the Electoral Commission will not be commenting further.
