Electoral Commission Referrals to the Police

The Electoral Commission has referred the following matters to the Police:

(1) John Creser: Distribution of election-related flyer on polling day
 
It is the Electoral Commission’s view that the distribution of the flyer constitutes a breach of sections 197(1)(g)(i), 199A, and 204F of the Electoral Act 1993 because Mr Creser distributed the flyer (which is an election advertisement, and which encouraged voters not to vote for the National Party) on polling day. 
 
(2) The alleged assault of an electoral official at an Advance Voting Facility in Tauranga on the afternoon of Friday, 25 November 2011
 
(3) The attempted theft of a ballot box and its contents from the Waharoa polling place on the afternoon of Saturday, 26 November 2011.
 
As these matters are now with the Police, the Electoral Commission will not be commenting further.
