By-election referrals to the Police
The Electoral Commission has referred five matters to the Police relating to social media posts made on election day for the Tāmaki Makaurau by-election.
The referrals involve content posted or shared on social media about different by-election candidates on Saturday 6 September.
Under section 197 of the Electoral Act 1993, it is an offence to publish, on election day, any statements advising or intended or likely to influence any elector as to the candidate the elector should vote or not vote for.
As this matter is now with the Police, the Electoral Commission will not be commenting further.
